TERMS OF SERVICE
1. Scope of Application
These Terms & Conditions apply to all services, collaborations, and inquiries involving Dominik Pohl, including but not limited to:
Videography and video production
Virtual production and in-camera VFX
3D design and animation
Broadcast and technical support
Drone operations
Creative consulting, planning, and direction
Educational or tutoring sessions
All work performed under the dominikpohl.com brand
They also apply to the use of this website and all digital content accessed through it.
2. Inquiry and Booking
All bookings are handled manually, not through automated online systems. Contact through this website does not constitute a binding agreement.
Agreements are concluded individually via written communication (e.g., email) or by signed contract. Separate written contracts override these general terms where applicable.
3. Pricing, Payment & VAT
Unless otherwise agreed:
A full invoice is sent after project completion.
In some cases (e.g., high upfront costs, long timelines), partial or full advance payments may be required.
All prices are subject to 19% German VAT unless the reverse-charge or other procedures apply.
Installments may be offered for long-term collaborations but are not standard.
4. Cancellation & Refunds
If not otherwise contractually agreed:
Any third-party costs (rentals, licenses, travel, tech) incurred before cancellation are fully chargeable.
A cancellation fee may apply depending on the size and timeline of the project (in line with §648 BGB).
There are no refunds for delivered work, even if it is not used by the client.
Accessing deliverables again at a later date may incur additional charges.
5. Intellectual Property & Usage Rights
All rights are transferred exclusively to the client unless otherwise agreed.
However:
Clients only receive the final, delivered content.
Project files, raw materials, unused designs, and internal development assets remain the property of the creator.
Unless otherwise agreed in writing (e.g., NDA), the creator retains the right to use the finished work for self-promotion and portfolio purposes.
AI Use Restrictions
The use of any delivered content — including video, images, audio, or 3D assets — in connection with artificial intelligence (AI) technologies (e.g., training data, generative models, synthesis tools) is strictly prohibited without prior written consent.
Portfolio Use Timing
Unless otherwise agreed, the creator may showcase completed work for self-promotional purposes no earlier than 30 days after final delivery.
6. Creative Process & Revisions
Unless otherwise stated:
Two rounds of revisions are included for minor and mid-level changes.
Major changes (e.g., reshoots, recuts, music changes, VFX) are considered additional work and will be billed separately.
Technical specifications (e.g., format, resolution, codec) must be defined at the start. Late changes may lead to additional costs.
The creative direction follows jointly developed ideas and reference samples, but leaves room for the creator’s interpretation and artistic freedom.
6a. Client Responsibilities
Clients agree to:
Provide timely feedback and all necessary materials (e.g. logos, scripts, reference files) during the collaboration.
Respond to feedback or approval requests within a reasonable timeframe.
Ensure that any third-party content they provide (e.g. music, stock footage) is legally licensed.
If the client fails to respond or engage in communication for more than 14 consecutive days without prior agreement, the project is considered completed, and the full agreed fee is payable.
The creator is not liable for any issues arising from:
Delays caused by client-side inaction
Third-party rights changes (e.g. expired music or stock licenses)
Any legal conflicts related to content supplied by the client
7. Right of Refusal
Dominik Pohl reserves the right to decline or withdraw from any project that:
Is unlawful
Violates personal ethics or moral values
Feels unsafe, discriminatory, or exploitative
Involves tasks beyond the creator’s capability or willingness
No justification is required for this decision.
8. Project Scope Changes
If the scope, workload, or expected value of a project changes significantly (by more than 10%), the creator has the right to renegotiate the terms.
If no new agreement is reached, the client must pay for all services delivered or started up to that point.
9. Travel, Health & Force Majeure
If a project cannot be fulfilled due to illness, personal circumstances, force majeure (e.g. natural disasters, strike, technical failure, public unrest, pandemics), or travel disruptions:
The obligation to perform the service is lifted.
No replacement or substitute delivery is owed.
Business partners and collaborators are not liable for completing the work.
If visa sponsorship is required for international work, it is the client's responsibility.
9a. Data Protection & Security Disclaimer
All personal data is handled in accordance with the applicable data protection laws. Please refer to the Privacy Policy for details.
While appropriate security measures are taken, the creator cannot guarantee complete protection against unauthorized access, hacking, or data loss. In the event of accidental data leaks or security breaches beyond the creator’s control, liability is limited to the extent permitted by law.
10. Limitation of Liability
The creator’s liability is limited to intent and gross negligence.
There is no liability for indirect, incidental, or consequential damages.
No guarantee is made beyond what has been confirmed in writing.
Website users accept that information may be updated or removed without notice.
11. Website Terms of Use
All content on this site is protected by copyright.
It may not be copied, reused, or republished without written consent.
Visitors may not engage in unlawful, abusive, or disruptive behavior while interacting with this site.
Hyperlinks to this site may be made without prior approval if done respectfully and lawfully.

12. Jurisdiction & Applicable Law
All collaborations and legal matters are governed by the laws of the Federal Republic of Germany.
Jurisdiction is Chemnitz, unless otherwise required by law (e.g. in consumer cases).
13. Severability
If any clause of these Terms is found invalid or unenforceable, the rest remains effective. A valid clause closest in meaning shall replace the invalid one.
